1. Overview

This website is operated by MAKE AMERICA SMART AGAIN, INC., doing business as Musobia (“Musobia,” “we,” “us,” or “our”).

Musobia operates an online political-satire art and merchandise store at musobia.shop. Our products may include shirts, mugs, tumblers, prints, and other merchandise featuring original Musobia characters, cartoons, commentary, and parody.

These Terms of Service (“Terms”) govern your access to and use of the Musobia website, store, products, information, communications, and related services collectively referred to as the “Services.”

By visiting the website, creating an account, submitting information, or purchasing a product, you agree to these Terms and to the additional policies referenced here, including our Privacy Policy, Refund Policy, and Shipping Policy.

Please do not use the Services or place an order if you do not agree to these Terms.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform used to display products, process orders, and support checkout.

2. Eligibility and Online Store Use

By using the Services, you represent that:

• You are at least the age of majority in your state, province, or country of residence; or
• You are using the Services with the permission and supervision of a parent or legal guardian.

You may not use the website, products, or Services:

• For an illegal or unauthorized purpose
• To violate intellectual-property laws
• To distribute viruses, malicious code, or harmful software
• To interfere with the website, checkout, accounts, or security systems
• To impersonate another person or provide false information
• To engage in fraud, abuse, harassment, threats, or unlawful discrimination
• To scrape, copy, reproduce, or commercially exploit website content without permission

We may restrict or terminate access when we reasonably believe these Terms, applicable laws, or the rights of Musobia or another party have been violated.

3. Political Satire, Parody, and Editorial Commentary

Musobia creates political satire, parody, caricature, fictional characters, humor, and editorial commentary.

Unless expressly stated otherwise:

• Musobia characters are fictionalized satirical portrayals.
• Captions and character quotations are original parody and are not actual quotations.
• References to politicians, public figures, campaigns, organizations, institutions, or current events are used for commentary, criticism, humor, and artistic expression.
• Musobia is not affiliated with, sponsored by, authorized by, or endorsed by any depicted person, political campaign, political party, government agency, corporation, school, religious organization, or other institution.
• The appearance of a person, name, symbol, slogan, or public event does not indicate endorsement or participation.

Musobia’s content represents artistic and editorial expression. Customers should not treat satire, parody, or caricature as factual reporting, legal advice, religious guidance, or official campaign communication.

4. Products and Print-on-Demand Fulfillment

Many Musobia products are created after an order is placed through print-on-demand fulfillment services, including Printify and independent production providers within its network.

Because products are made to order:

• Production may begin shortly after an order is submitted.
• Order changes or cancellations might not be possible after production begins.
• Different products in the same order may be manufactured or shipped separately.
• Products may arrive in multiple packages.
• Production and shipping locations may vary.
• Product availability may depend on the selected size, color, material, print provider, or destination.

Printify operates as a print-on-demand fulfillment platform and may arrange for products to be printed and delivered through third-party production providers.

5. Product Images, Colors, and Variations

We make reasonable efforts to display product images, colors, dimensions, placement, and descriptions accurately.

However:

• Computer and mobile screens display colors differently.
• Product mockups are visual representations and might not exactly reproduce the finished item.
• Minor variations in color, print placement, dimensions, stitching, texture, or image scale may occur.
• Different print providers, production equipment, garments, and materials may create small differences between items.
• Product measurements may vary within normal manufacturing tolerances.

Printify states that minor discrepancies in color and placement can occur because providers use different production equipment and supplies.

Normal production variations do not automatically make a product defective. Significant printing errors, damage, or receipt of the wrong item will be reviewed under our Refund Policy.

6. Product Availability and Changes

All products and variants are subject to availability.

We may:

• Add or remove products
• Change product descriptions
• Change colors, sizes, materials, or providers
• Limit quantities
• Discontinue products or variants
• Correct product information
• Change prices
• Refuse or cancel orders when reasonably necessary

We are not obligated to continue offering a product, character, design, size, or color indefinitely.

7. Prices, Taxes, and Payments

Prices are displayed in the currency shown during checkout and may change without notice.

Unless expressly stated otherwise:

• Product prices do not include shipping.
• Applicable sales taxes may be calculated during checkout.
• International customers may be responsible for customs duties, import taxes, brokerage charges, or other government fees.
• Discounts and promotional offers may be changed, limited, or discontinued.
• A pricing or technical error does not obligate us to complete an order at an obviously incorrect price.

Payments are processed through Shopify and available third-party payment providers. You agree to provide accurate billing information and represent that you are authorized to use the selected payment method.

We may cancel or hold an order when payment cannot be verified or when fraud, misuse, unauthorized resale, or suspicious activity is reasonably suspected.

8. Order Acceptance

Submitting an order does not guarantee acceptance.

An order is subject to:

• Successful payment authorization
• Product and variant availability
• Address verification
• Fraud and security review
• Compliance with these Terms
• Fulfillment-provider availability

We may limit or cancel orders placed by the same customer, account, payment method, billing address, or shipping address when reasonably necessary.

When possible, we will use the contact information supplied with the order to notify the customer of a significant change or cancellation.

9. Customer Information and Shipping Addresses

You are responsible for providing complete and accurate:

• Name
• Email address
• Billing information
• Shipping address
• Apartment or unit number
• Postal code
• Telephone number when required for delivery

Musobia is not responsible for delivery problems caused by an incomplete, outdated, or incorrect address supplied by the customer.

Orders returned because of an incorrect or undeliverable address may require additional production or shipping charges before being resent.

10. Production, Shipping, and Delivery

Production and delivery dates are estimates unless expressly guaranteed in writing.

Delivery may be affected by:

• Product availability
• Production-provider capacity
• Carrier delays
• Weather
• Holidays
• Customs processing
• Incorrect addresses
• Regional disruptions
• Events outside our reasonable control

A shipment marked delivered by the carrier does not automatically establish that Musobia or the fulfillment provider caused a later loss or theft.

Customers should contact Musobia promptly regarding a missing, damaged, or incorrectly delivered order. Shipping questions and delivery procedures are explained further in our Shipping Policy.

11. Returns, Refunds, Reprints, and Replacements

Returns, refunds, reprints, exchanges, replacements, and cancellations are governed by the Musobia Refund Policy.

Because many products are created specifically after an order is placed:

• Change-of-mind returns may be restricted.
• Incorrect size or color selections made by the customer might not qualify for a free replacement.
• Orders might not be cancellable after production begins.
• Clear photographs may be required to evaluate damage, defects, or printing errors.
• Customers should keep the item and packaging until the claim is resolved.
• Approved refunds are generally returned to the original payment method.

Products that arrive damaged, materially defective, incorrectly printed, or different from the ordered item will be reviewed according to the Refund Policy and applicable law.

Shopify requires merchants to maintain a current, accurate, and easily accessible refund policy.

12. Intellectual Property

Unless otherwise stated, the website and its content are owned by or licensed to MAKE AMERICA SMART AGAIN, INC.

Protected content may include:

• Musobia character names and designs
• Cartoons and illustrations
• Product artwork
• Logos
• Captions and original satire quotations
• Collection descriptions
• Website copy
• Product photographs and mockups
• Videos
• Graphics
• Layouts and branding

Purchasing a product gives the customer ownership of that physical product. It does not transfer copyright, trademark rights, licensing rights, reproduction rights, merchandising rights, or commercial-use rights in the artwork.

Without prior written permission, you may not:

• Reproduce Musobia artwork on other products
• Sell copies or derivatives
• Remove signatures, logos, or copyright notices
• Upload the artwork to another print-on-demand service
• Use the artwork in advertising or commercial branding
• Mint or sell the artwork as a digital token or similar product
• Use automated tools to scrape or systematically copy the website
• Use Musobia artwork or written content to train commercial artificial-intelligence systems, except where such restriction is prohibited by applicable law

You may share links to Musobia pages and unaltered promotional images for personal, noncommercial discussion, commentary, or social-media sharing, provided the content is not presented as your own work.

13. User Reviews, Messages, and Submissions

When you submit a review, comment, photograph, message, suggestion, or other material to Musobia, you represent that:

• You own or have permission to submit it.
• It is accurate to the best of your knowledge.
• It does not violate another person’s rights.
• It does not contain unlawful, defamatory, threatening, obscene, fraudulent, or malicious content.
• It does not contain malware or harmful code.

You grant Musobia a nonexclusive, worldwide, royalty-free license to display, reproduce, and use submitted reviews or promotional customer photographs in connection with operating and promoting the store.

This license does not transfer ownership of your original submission.

We may remove or decline to publish user content that violates these Terms.

Unsolicited character ideas, artwork, campaign ideas, concepts, or creative proposals should not be submitted with an expectation of confidentiality, compensation, or ownership participation.

14. Third-Party Services and Links

The website may use or link to third-party services, including:

• Shopify
• Printify
• Payment processors
• Shipping carriers
• Social-media platforms
• Analytics providers
• News websites
• Embedded media
• Marketing or email services

Third parties operate under their own terms and privacy policies. Musobia does not control and is not responsible for the content, security, availability, or practices of unrelated third-party websites.

Your use of a third-party service is at your own discretion and may be governed by an agreement between you and that provider.

15. Privacy

Our collection and use of personal information are governed by the Musobia Privacy Policy.

Information required to process and fulfill an order may be shared with Shopify, payment providers, Printify, production providers, and shipping carriers as described in that policy.

16. Errors and Corrections

The website may occasionally contain typographical errors, outdated information, incorrect product data, pricing mistakes, or technical problems.

We may correct errors, update information, or cancel an affected order when reasonably necessary, including after an order has been submitted.

We are not obligated to update every historical article, satire reference, or archived product unless required by law.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and Services are provided on an “as available” basis.

We do not guarantee that:

• The website will always be uninterrupted or error-free.
• Every product will remain available.
• Every browser or device will display the website identically.
• Search engines, social platforms, or advertising services will display or approve particular content.
• Satirical content will be interpreted in the same way by every viewer.
• Website information will always be free from minor errors.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, MAKE AMERICA SMART AGAIN, INC., Musobia, and their officers, employees, contractors, service providers, suppliers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the website or purchase of a product.

Where liability cannot legally be excluded, our total liability relating to a product or transaction will be limited to the amount paid for the product giving rise to the claim, except where applicable law requires a different remedy.

This section does not limit liability for fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot legally be limited.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless MAKE AMERICA SMART AGAIN, INC., Musobia, and their officers, employees, contractors, and service providers from third-party claims arising from:

• Your unlawful use of the Services
• Your violation of these Terms
• Your violation of another party’s intellectual-property, privacy, or other rights
• Content you submit to the website
• Fraudulent or malicious activity associated with your account

This obligation does not apply to claims caused solely by Musobia’s unlawful conduct.

20. Termination

You may stop using the Services at any time.

We may suspend or terminate access when we reasonably believe a user has violated these Terms, committed fraud, interfered with the website, infringed intellectual property, or created a security or legal risk.

Provisions concerning payment obligations, intellectual property, limitations of liability, indemnification, and dispute resolution survive termination where appropriate.

21. Severability

If any part of these Terms is found unlawful or unenforceable, that portion will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

22. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

23. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and other policies displayed on the website, constitute the agreement governing use of Musobia’s Services.

They replace prior discussions or understandings concerning the same subject, except for a separate written agreement signed by an authorized representative of Musobia.

24. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or the Services will be brought in a court with appropriate jurisdiction in Florida, unless applicable consumer law gives the customer the right to bring a claim elsewhere.

25. Changes to These Terms

We may update these Terms to reflect changes in the store, products, fulfillment services, technology, or legal requirements.

The revised Terms will be posted with an updated effective date. Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
